Laborer sues joint employers over alleged unpaid wages

MIAMI – A laborer is suing his employers over allegations of unpaid overtime.

Eduard Ismel Morales filed a complaint on March 8 in the U.S. District Court for the Southern District of Florida, Miami Division against TDI Millwork Inc., Trend Corp. and Troy D. Ippolito, citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he did not receive overtime compensation during his employment. The plaintiff holds TDI Millwork Inc., Trend Corp. and Troy D. Ippolito responsible because the defendants allegedly refused pay him the full and proper overtime wages of time-and-one-half of his regular rate for all hours worked over 40 each week.

The plaintiff seeks the following: compensation for liquidated damages, attorneys’ fees and costs and such other remedy as the court may deem just and appropriate. He is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
