Woman seeks disability benefits from Life Liberty Assurance Co.

MIAMI – A woman is suing her insurance company over alleged denial of disability benefits.

Lissette V. Moore filed a complaint on March 8 in the U.S. District Court for the Southern District of Florida against Life Liberty Assurance Co. of Boston, citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that from Nov. 1, 2014, to the present date, she has not received long-term disability benefits she claims are owed to her. The plaintiff holds Life Liberty Assurance Co. of Boston responsible because the defendant allegedly has denied her benefits, failed to provide a reasonable explanation of the basis for the denial of her claim and failed investigate and to provide a fair and full review of her claim.

The plaintiff seeks the following: an order declaring that she is entitled to immediate reinstatement to the plan; attorneys’ fees and costs, prejudgment and post-judgment interest; and any further relief that the court may deem just and proper. She is represented by Victor Peña and Gregory Michael Dell of Attorneys Dell & Schaefer Chartered in Hollywood.
