Woman alleges mortgage company called her at least 1,700 times

TAMPA – A Hillsborough County woman alleges that a financial institution has engaged in illegal debt collection practices by repeatedly calling her in an attempt to collect on a debt purportedly belonging to her late father.

Alicia Cummings filed a complaint on March 2 in the Tampa Division of the Middle District of Florida against Regions Bank, doing business as Regions Mortgage, alleging that the financial institution violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that she has received at least 1,700 unwanted and unlawful phone calls without her prior express consent. The suit states that she did not provide her number to the defendant in relation with the alleged debt, nor was she appointed as the administrator of her father's estate. The plaintiff holds Regions Mortgage responsible because the defendant allegedly made pre-recorded telephone calls using an automated telephone dialing system despite requests to stop.

The plaintiff seeks the following: an injunction requiring defendant to stop all communications in violation of TCPA; compensation for statutory and actual damages, attorneys' fees and costs; and any further relief that the court may deem appropriate.
