TracFone sues marketing agent over alleged breach of duty

MIAMI – A Miami wireless provider is suing a marketing agent over allegations its employees improperly enrolled people into its SafeLink program to increase their commissions.

TracFone Wireless Inc. filed a complaint on Feb. 23 in the U.S. District Court for the Southern District of Florida against US Connection LLC, doing business as US Connect, citing negligence, unjust enrichment and other counts.

According to the complaint, the plaintiff alleges that it has suffered damages of more than $75,000. The plaintiff holds US Connect responsible because the defendant allegedly failed to properly train and educate its Street Team employees on the requirements for TracFone's SafeLink program, failed to supervise its Street Team employees to properly enroll eligible individuals to the SafeLink program and failed to exercise reasonable care and skill in the performance of the work required to be done. The suit states that more than 20,000 ineligible people were enrolled, which totaled more than $9 million in commissions from TracFone.

The plaintiff seeks the following: compensation for damages, prejudgment and post-judgment interest and attorneys' fees and costs. The plaintiff is represented by Steven J. Brodie and Aaron S. Weiss of Carlton Fields Jorden Burt PA in Miami.
