Former employee accuses DeBartolo Construction Services of not paying overtime wages

ORLANDO – A construction superintendent filed a suit against his former employer alleging he was not paid overtime wages in violation of federal law.

Timothy Gable filed a complaint on Feb. 23 in the U.S. District Court for the Middle District of Florida, Orlando Division against DeBartolo Construction Services LLC, citing violations of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Feb. 27, 2013, and June 13, 2014, he did not receive proper overtime compensation. The plaintiff holds DeBartolo Construction Services LLC responsible because the defendant allegedly failed to pay time-and-one-half of his statutory regular rate for each hour worked in excess of 40 hours in a work week.

The plaintiff seeks the following: liquidated damages, prejudgment and post-judgment interest, reasonable attorney's fees and costs and any further relief that the court may deem just and appropriate. He is represented by J. Corey Moore and C. Ryan Morgan of Morgan & Morgan PA in Orlando.
