Assisted-living facility sued in claim for overtime

ORLANDO — A construction worker is suing an assisted-living facility and its owner, claiming he was not properly compensated for overtime work.

Kenneth Vogel sued Plantation Oaks Senior Living Management LLC and Gregory Morris, claiming the defendants did not pay him the mandated rate of time and a half for all hours worked above 40 per week during the period from about February 2012 to March 2014.

The construction worker filed a complaint on Feb. 23 in U.S. District Court for the Middle District of Florida Orlando Division, alleging the defendants intentionally violated the Fair Labor Standards Act.

The plaintiff seeks the following: compensation for liquidated damages, pre-judgment and post-judgment interest, reasonable attorneys' fees and costs and any further relief that the court may deem just and appropriate. He is represented by J. Corey Moore and Carlos V. Leach of Morgan & Morgan, P.A. in Orlando.
