Disabled man sues restaurant, property owner over accessibility

MIAMI — A Broward County man who acts as a "tester" to find alleged discrimination against disabled people in public accommodations has sued a restaurant and its landlord, claiming the restaurant's bathroom did not accommodate wheelchair users.

Julius Seiler sued MSKP Ramblewood Square LLC, owner of the Coral Springs property, and Dong Le Corporation, doing business as Shinju Japanese Buffet Sushi Seafood Hibachi Grill, on Feb 22 in U.S. District Court for the Southern District of Florida, alleging that the defendants violated the Americans With Disabilities Act.

The plaintiff alleges that, on Feb. 13,, he was denied full and equal access to and enjoyment of the defendants' facilities and amenities. The plaintiff holds MSKP Ramblewood Squar, LLC and Dong Le Corporation responsible because the defendants allegedly failed to provide suitable access to the restroom for disabled persons.

The plaintiff seeks the following: compensation for reasonable attorney's fees, costs and other expenses; an order to require defendants to make their facilities accessible and usable by people with disabilities; and any further relief that the court may deem necessary.
