The Futon Co. accused of ADA violations

MIAMI – A Broward County man is suing furniture store owners over allegations it prohibits access to those with disabilities.

Lional Dalton filed a complaint on Feb. 22 in the U.S. District Court for the Southern District of Florida against Paul F. Martucci, Karen L. Martucci and Harmony Home Furnishings, doing business as The Futon Co., citing alleged failure to uphold Americans with Disabilities Act regulations.

According to the complaint, the plaintiff alleges that on Feb. 18, he was denied full and safe equal access for the enjoyment of defendants' facilities and amenities. The plaintiff holds the defendants responsible because they allegedly do not have an accessible restroom and a continuous path of travel through the store.

The plaintiff seeks the following: compensation for reasonable attorneys' fees, costs and other expenses; an order to require defendants to make their facilities accessible and usable by persons with a disability; and any further relief that the court may deem necessary.
