St. Augustine woman files suit against debt collector

JACKSONVILLE – A St. Augustine woman is suing a debt collector over allegations its letters were misleading.

Elsie Taylor filed a complaint on Feb. 25 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against D.S. Erickson & Associates PLLC alleging that the debt collector violated the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that she was obligated to pay a debt owed or due. The plaintiff holds D.S. Erickson & Associates PLLC responsible because the defendant allegedly did not include notices and information for Spanish speakers as required by law and stated incorrect debt amounts.

The plaintiff seeks the following: compensation for statutory damages in the amount of $1,000, actual damages, attorneys’ fees and costs and any further relief that the court may deem just and proper. She is represented by Alex D. Weisberg of Weisberg Consumer Law Group PA in Cooper City.
