Man claims telephone harassment by retailer

FORT MYERS — A Lee County man is suing a retailer claiming alleged invasion of privacy and violation of telephone harassment statutes.

Jorge Perez is suing Bluestem Brands Inc., doing business as department-store company Fingerhut. Perez sued on Feb. 24, in U.S. District Court for the Middle District of Florida Fort Myers Division, alleging that Bluestem Brands willfully violated the Telephone Consumer Protection Act and the Florida Consumer Collections Practices Act.

According to the complaint, the plaintiff alleges that he has received numerous calls without his prior express consent. The plaintiff holds Bluestem Brands responsible because the defendant allegedly repeatedly placed calls on his cellular telephone using an automatic telephone dialing system.

The plaintiff seeks the following: compensation for statutory, punitive, actual and treble damages, costs for this action, interest and any other relief that the court may deem just and proper. He is represented by Frank H. Kerney III of Morgan & Morgan, Tampa, P.A. in Tampa.
