MIAMI – A disabled man has filed a suit against two businesses alleging that they restrict access to those who use wheelchairs.
Garfield Spence filed a complaint on Feb. 17 in the U.S. District Court for the Southern District of Florida against Uncle Lee of Coral Springs Inc. and 10400 Atlantic Inc., doing business as Jacky Lee's, alleging that they violated the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that in February he was denied equal enjoyment of the goods, services, and/or accommodations offered at Jacky Lee's. The plaintiff holds the defendants responsible because they allegedly failed to remove physical barriers to offer access to individuals with disabilities. The suit states Uncle Lee of Coral Springs is property's operator.
The plaintiff seeks the following: an order of permanent injunction from continuing defendants' alleged discriminatory practices; and order to remove the physical barriers; and compensation for attorneys' fees, litigation expenses and costs.
