Store clerk sues yogurt shop for allegedly unpaid wages

MIAMI – A Miami-Dade County man is suing his former employer over allegations of unpaid wages.

Zachary Endicott filed a complaint on Feb. 18 in the U.S. District Court for the Southern District of Florida, Miami Division against Yogurtblast LLC, doing business as Menchie's Frozen Yogurt Homestead, and Jose Mendez, citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was not was not paid overtime wages for three hours during his employment from March 2015 to February 2016. He also alleges that he did not receive any wages during his last three weeks of employment. The plaintiff holds Menchie's Frozen Yogurt Homestead and Jose Mendez responsible because the defendant allegedly refused to pay the required minimum wage and the statutory rate of time-and-one-half of his regular rate for all hours worked in excess of the 40 hour work week.

The plaintiff seeks the following: compensation for liquidated damages, attorneys' fees and costs, prejudgment interest and other relief that the court may deem reasonable.
