Disabled woman sues insurance company over allegedly denying benefits

MIAMI – A former bank employee is suing her insurance company over allegations it wrongfully denied her benefits.

Irina Peschansky filed a complaint on Feb. 16 in the U.S. District Court for the Southern District of Florida against The Prudential Insurance Co. of America alleging that the insurance company knowingly violated the Employee Retirement Income Security Act by terminating her long-term disability benefits.

According to the complaint, the plaintiff alleges that, from June 30, 2015, to the present date, she has not received disability benefits owed to her. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly failed to properly investigate the merits of her claim.

The plaintiff seeks the following: an order to immediate reinstatement her to plan; compensation for disability benefits due, attorneys’ fees and costs, prejudgment and post-judgment interest and any further relief that the court may deem just and proper. She is represented by Alexander A. Palamara and Gregory Michael Dell of Attorneys Dell & Schaefer Chartered in Hollywood in Florida.
