FORT MYERS – A Lee County man has filed a suit against a restaurant owner over allegations of unpaid wages.
Gerardo Prieto filed a complaint on Feb. 17 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Scheeler's Cafe De Marco Inc. and Sandy Franchino, alleging that the restaurant owner intentionally violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between 2002 and July 2015, he did not receive proper overtime compensation. The plaintiff holds Scheeler's Cafe De Marco Inc. and Sandy Franchino responsible because the defendants allegedly refused to pay the statutory rate of time-and-one-half of his regular rate for all hours worked in excess of the 40 hours work per week.
The plaintiff seeks the following: compensation for actual and liquidated damages, attorney's fees and costs and any other relief that the court may deem just and proper. He is represented by Angeli Murphy of Morgan & Morgan PA in Plantation.
