FORT MYERS — A Broward County woman is suing a property owner, citing alleged discrimination and failure to uphold Americans with Disabilities Act regulations.
Patricia Kennedy sued Roumely Inc., doing business as Kingston Square Plaza in Fort Myers, on Feb. 19 in U.S. District Court for the Middle District of Florida.
The plaintiff claims the property owner failed to comply with the law's standards for new construction and alteration.
Kennedy alleges that she was deprived of her choice to freely visit establishments readily available to the general public. The plaintiff holds Roumely responsible because the defendant allegedly denied her access to a full and equal enjoyment of the goods, services, facilities and/or accommodations being offered.
The plaintiff seeks the following: an order to make the facility readily accessible to individuals with disabilities; compensation for attorney’s fees, costs and litigation expenses; and any other relief that the court may deem just and proper.
