Man sues property owner over alleged disability discrimination

MIAMI – A man is suing a spa over allegations it restricts access to the disabled.

Eric Rogers filed a complaint on Feb. 17 in the U.S. District Court for the Southern District of Florida against Siern Spa & Facial LLC and James H. Batmasian, property owner, citing alleged disability discrimination and failure to uphold Americans with Disabilities Act regulations.

According to the complaint, the plaintiff, who uses a wheelchair, alleges that he was denied access to equal enjoyment of the goods, services, facilities, privileges, advantages and/or any accommodations offered therein. The plaintiff holds the defendants responsible because they allegedly failed to remove architectural barriers that block access to individuals with disabilities.

The plaintiff seeks the following: compensation for attorneys' fees and costs; a permanent injunction on defendants' discriminatory practices; and an order to remove the physical barriers. He is represented by Douglas S. Schapiro of The Schapiro Law Group PL in Boca Raton.
