Gucci sues businesses over alleged counterfeit goods

Justice

MIAMI – A luxury goods company is suing multiple websites over allegations that they sell counterfeit goods.

Gucci America Inc. filed a complaint on Feb. 16 in the U.S. District Court for the Southern District of Florida against hotsalehandbags.co.uk, replicabagsforsale.co.uk, ukhandbagsonline.co.uk, et al. and Does 1-10, citing trademark counterfeiting and infringement and other counts.

According to the complaint, the plaintiff alleges that it has suffered and will continue to suffer irreparable damages. The plaintiff holds the defendants responsible because they allegedly manufactured, distributed, advertised and sold fake Gucci items. The plaintiffs allege this caused confusion, mistake and deception among members of the trade and the general consuming public.

The plaintiff seeks the following: an entry of permanent injunctions on defendants from manufacturing and distributing of counterfeit goods; an order to cancel or transfer subject domains to plaintiff's control; compensation for all profits and damages; prejudgment and post-judgment interest; attorneys’ fees and costs; and any further relief that the court may deem just and proper. It is represented by T. Raquel Rodriguez-Albizu, Virgilio Gigante and Stephen M. Gaffigan of Stephen M. Gaffigan PA in Fort Lauderdale.
