FORT MYERS – A Lee County woman is accusing her former employer of allegedly not notifying her of her rights regarding health benefits after her termination.
Jacquelyn Levin filed a complaint on Feb. 19 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Kingdom Animalia, doing business as Hourglass Cosmetics, alleging that the beauty products manufacturer knowingly violated the Consolidated Omnibus Budget Reconciliation Act.
According to the complaint, the plaintiff alleges that she has accrued medical expenses since she was terminated by the company in August 2015. She holds Hourglass Cosmetics responsible because the defendant allegedly failed to notify her of her right to continue her health insurance coverage under COBRA.
The plaintiff seeks the following: damages of $110 per day from the date she was terminated until the COBRA notification when into effect, attorneys' fees and costs and any further relief that the court may deem appropriate.
