TracFone sues mobile app developer over alleged misappropriation of trade secrets

MIAMI – A wireless provider is suing a mobile app developer, alleging that it misused the plaintiff's confidential information.

TracFone Wireless Inc. filed a complaint on Feb. 23 in the U.S. District Court for the Southern District of Florida against VMBC, formerly known as Voice & Mobile Broadcast Corp., citing breach of implied warranty, negligence misrepresentation, unjust enrichment and other counts.

According to the complaint, the plaintiff contracted with the defendant in 2007 to design software for the Lifeline Enrollment and Record Management Services. The plaintiff alleges that it suffered monetary damages because the defendant allegedly used the confidential information about TracFone for its own monetary gain.

The plaintiff seeks the following: an order requiring defendant to cease marketing and selling any products or services contained in confidential information, attorneys' fees and costs. It is represented by Steven J. Brodie Bar and Aaron S. Weiss of Carlton Fields Jorden Burt PA in Miami.
