MIAMI – Parents are suing the U.S. government over allegations of medical negligence in relation to the birth of their infant.
Jereisha Ortiz-Soto and Ulysses Trinidad, as guardians and parents of the minor child J.T., filed a complaint on Feb. 22 in the U.S. District Court for the Southern District of Florida, Miami Division against the United States of America, citing negligence.
According to the suit, the plaintiffs allege that the government failed to investigate the circumstances to determine if there was negligence in care and treatment of the mother and child at the Jessie Trice Community Health Center in Miami-Dade County from 2012 to 2013, which is a U.S. Department of Health and Human Services agency.
The plaintiffs allege that Jereisha Ortiz-Soto gave birth to a child with permanent brain injury and permanent total disabilities. The plaintiffs holds United States of America responsible because its agency allegedly failed to appropriately evaluate the condition of the mother and the child's status during birth.
The plaintiffs seek compensatory damages and the costs for the action. They are represented by Hector J. Lombana and Araly Herrera of Gamba, Lombana & Herrera in Coral Gables.
