Bread Partners 21 Inc. faces suit over alleged violation of FLSA

MIAMI – A Miami-Dade County woman alleges her former employer did not pay overtime wages.

Elietta Ayerdis filed a lawsuit against Bread Partners 21 Inc., doing business as Au Bon Pain, on Feb. 23 in the U.S. District Court for the Southern District of Florida, Miami Division, citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between July 2011 and Aug. 14, 2015, after working for approximately 50 hours per week, she was paid for 35 hours by paycheck and an additional 15 hours in cash. She was never paid overtime wages for hours worked more than 40 per week, the suit states.

The plaintiff seeks the following: compensatory and liquidated damages, legal fees and any other relief this court deems just and proper. She is represented by Daniel T. Feld of Law Office of Daniel T. Feld PA in Aventura and Isaac Mamane of Mamane Law LLC in Bay Harbor Islands.
