MIAMI – A Miami-Dade County woman is suing her former employer over allegations of unpaid overtime.
Adaismay Mejia filed a lawsuit on Feb. 22 in the U.S. District Court for the Southern District of Florida, Miami Division against General Asphalt Co. Inc., citing violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between August 2000 and Jan. 8, she worked for more than 40 hours per week but didn't receive any overtime wages. The plaintiff holds General Asphalt Co. Inc. responsible because the defendant allegedly failed to properly compensate plaintiff for hours worked over 40 per week despite of having knowledge of the total hours worked by the plaintiff. The defendant also allegedly attempted to waive all rights to her overtime pay by signing a severance agreement.
The plaintiff seeks the following: compensation for all damages suffered in pursuant to the Fair Labor Standards Act, unpaid wages, legal fees and any other relief this court deems just and proper.
