Woman claims insurer improperly cut off benefits

MIAMI — A former Publix supermarket worker is suing Hartford Life and Accident Insurance Company, claiming the insurer improperly stopped paying her long-term disability benefits.

Asencion Luna sued on Feb. 19 in U.S. District Court for the Southern District of Florida, claiming Hartford wrongfully violated the Employee Retirement Income Security Act by terminating her long-term disability benefits.

The plaintiff alleges that she became disabled in October 2012 and that Hartford paid her benefits until Jan. 14, 2015, but terminated her claim after that date. The plaintiff holds Hartford Life and Accident Insurance Company responsible because the defendant allegedly failed to properly investigate the merits of her disability claim.

The plaintiff seeks the following: a declaration that she is entitled to immediate reinstatement to the long-term disability plan, compensation for disability benefits due, attorneys’ fees and costs, pre-judgment and post-judgment interest and any further relief that the court may deem just and proper.
