Consumers sue car makers over airbag claim

MIAMI — Four consumers have filed a class-action lawsuit against vehicle manufacturers over allegations of defective airbag control units.

Lourdes Leon, Alexander Paz, Seth Burack and Nuria Reina filed suit on Feb. 17 in U.S. District Court for the Southern District of Florida Miami Division against Continental AG, Continental Automotive Systems Inc., Continental Automotive Systems U.S. Inc., Atmel Corp., Daimler AG, Mercedes-Benz USA LLC, Honda Motor Co. Ltd. and American Honda Motor Co. Inc.

The four consumers claim the defendants violated U.S. safety regulations by not disclosing their knowledge of the defect.

The four plaintiffs claim that the allegedly defective airbag control units make their vehicles worth less than comparable vehicles without a defect, and their suit says they therefore overpaid for their vehicles.

The plaintiffs seek the following: compensation for statutory damages, including interest, attorneys’ fees and costs, pre-judgment and post-judgment interest and any further relief that the court may find appropriate. They are represented by Robert C. Gilbert, Avi R. Kaufman and Scott A. Edelsberg of Kopelowitz Ostrow Ferguson Weiselberg Gilbert in Coral Gables, Florida.
