Insurance company claims breach of policy conditions

TAMPA — An insurance company is suing several parties in the aftermath of a traffic accident, claiming it has no duty to pay any damages because special conditions of a policy were breached.

Tudor Insurance Company sued Zelwin LLC, Zelwin2 LLC, Zelwin3 LLC doing business as Jimmy John's, Zachary Glomb, Michael Rountree and Auto-Owners Insurance Company on Feb. 18 in U.S. District Court for the Middle District of Florida Tampa Division, alleging that a Jimmy John's driver who was involved in an accident was allowed to drive despite being unqualified.

The plaintiff says Glomb was allowed to drive for a Hillsborough County Jimmy John's despite not having two years' driving history. Glomb allegedly was driving when he collided with Rountree's vehicle, causing injury and damages to Rountree.

The plaintiff seeks the following: a declaration that coverage is voided and that it has no duty to pay any damages, attorneys' fees and costs for this action, and any other relief that the court may deem just and appropriate.
