Clinic sues financial institutions over alleged sending of unsolicited advertisements

MIAMI – A Cape Coral chiropractic office has filed a class-action suit against several financial institutions over claims they sent a junk fax.

Scoma Chiropractic PA filed a class-action lawsuit against Celtic Bank, Kabbage Inc., Loanme Inc and John Does 1-10 on Feb. 18 in the U.S. District Court for the Southern District of Florida alleging that they knowingly violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on Jan. 4 it received unsolicited advertisements via facsimile transmission without its prior express permission. The plaintiff holds the defendants responsible because the fax allegedly did not include the required opt-out language.

The plaintiffs seek the following: compensation for actual monetary loss or the sum of $500 for each violation, pre-judgment interest, costs and any further relief that the court may deem just and proper. It is represented by Ryan M. Kelly of Anderson & Wanca in Rolling Meadows, Illinois.
