Former general manager sues Stein Mart over alleged illegal termination

FORT PIERCE – A former general manager is suing a department store chain over allegations she was retaliated against for taking medical leave.

Sara Zabukovec filed a complaint on Feb. 17 in the U.S. District Court for the Southern District of Florida, Fort Pierce Division against Stein Mart Inc., citing violation of the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that she was terminated on Sept. 26, 2015, after a 13-year career with the defendant. She alleges she fell on Jan. 30, 2015, at the office, suffered a knee injury and took a three-week leave and filed a workers' compensation claim. She claims that when she returned, she suffered retaliatory harassment for taking medical leave.

The plaintiff seeks the following: compensation for back pay, loss of income and benefits, emotional distress, attorney’s fees and costs and any other relief that the court may deem just and appropriate.
