Comenity Bank accused of telephone harassment

MIAMI – A Miami-Dade County resident is suing a bank over allegations that it harassed her by calling her cellphone more than 1,000 times.

Topacio Quinonez filed a complaint Feb. 16 in the U.S. District Court for the Southern District of Florida, Miami Division against Comenity Bank, alleging that it intentionally violated the Telephone Consumer Protection Act by calling her frequently using an automatic telephone dialing system.

According to the complaint, the plaintiff alleges that, since Jan. 1, 2015, she has received numerous pre-recorded calls from the defendant without her express permission in an attempt to collect a debt. The plaintiff holds Comenity Bank responsible because it allegedly placed approximately 1,500 unwanted calls to her cellular telephone.

The plaintiff seeks the following: compensation for actual, statutory and punitive damages, attorney's fees and costs and any other relief that the court may deem just and proper. She is represented by Octavio "Tav" Gomez of Morgan & Morgan, Tampa P.A. in Tampa.
