Prudential Insurance Co. of America accused of wrongfully denying benefits

MIAMI – A disabled person alleges his insurance company wrongfully denied his disability benefits claim.

Garth Henriksen filed a complaint on Feb. 12 in the U.S. District Court for the Southern District of Florida against Prudential Insurance Co. of America alleging that the insurance company violated the Employee Retirement Income Security Act by terminating his claim for benefits.

According to the complaint, the plaintiff alleges that he received disability benefits from March 7, 2013, to March 7, 2015, when the defendant terminated his claim. The suit states that the defendant determined Henriksen was no longer disabled under the gainful occupation of disability.

The plaintiff seeks the following: compensation for disability benefits due, attorney’s fees and costs, prejudgment and post-judgment interest and any further relief that the court may deem just and proper; and immediate reinstatement to the plan. He is represented by Stephen F. Jessup of Attorneys Dell & Schaefer Chartered in Hollywood.
