Miami-Dade County homeowner is suing mortgage lender over alleged fees

MIAMI – A Miami-Dade County homeowner is suing a mortgage lender over claims it unlawfully increased the amount of her debt by charging fees without a reasonable basis.

Marva D. Pitter filed a complaint on Feb. 11 in the U.S. District Court for the Southern District of Florida against Nationstar Mortgage LLC, citing violation of the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges Nationstar Mortgage LLC performs frequent property inspections in order to add fees to increase the amount of debt owed by the plaintiff. She also alleges that the defendant has not provided her with an accurate payoff statement.

The plaintiff seeks the following: compensation for actual damages, statutory damages, reasonable attorney’s fees and costs and any other relief that the court may deem just and proper. She is represented by Aaron Silvers of Loan Lawyers LLC in Fort Lauderdale.
