TAMPA — A Polk County woman is suing a debt collection agency, claiming invasion of privacy and violation of telephone harassment statutes.
Tina Johnson sued Navient Solutions Inc. on Feb. 10 in U.S. District Court for the Middle District of Florida, alleging that the debt collector willfully harassed and abused her by frequently calling her cellular telephone number despite her pleas to stop.
According to the complaint, the plaintiff alleges that, from April 2015 to the present, she received unwanted telephone calls seeking to collect on a student loan, which only stopped for a few weeks after the plaintiff requested that the calls end in September 2015. The plaintiff alleges that she was called while visiting her husband at a hospital where he was treated for Stage 4 cancer; on the day of his death in October 2015; on the day of his funeral; and continuing to the present.
The plaintiff seeks the following: compensation for statutory, punitive and actual damages, attorney's fees and costs and any further relief that the court may deem just and proper. She is represented by Octavio "Tav" Gomez of Morgan & Morgan, Tampa, P.A. in Tampa, Florida.
