Man sued for allegedly misleading insurance company

PENSACOLA — A man described as an Escambia County Jail inmate is being sued by an insurance company that claims he committed intentional misrepresentations.

Berkshire Life Insurance Company of America sued Brent D. Allen on Feb. 10 in U.S. District Court for the Northern District of Florida Pensacola Division, alleging that Allen intentionally made false statements and omissions about his employment, earnings and medical history when enrolling in a disability insurance policy.

According to the complaint, the plaintiff alleges that it has already paid a total $359,080 in benefits. The plaintiff holds Allen responsible because the defendant allegedly lied in his disability income insurance policy application form.

The plaintiff seeks the following: denial of disability claim, return of the money amounting to $359,080, reasonable attorneys' fees and costs and any further relief that the court may deem just and equitable. He is represented by Wm. Jere Tolton, III and Richard S. Maselli of Ogden & Sullivan, P.A. in Tampa, Florida.
