PALM BEACH – A Lake Worth frameless cabinet company is suing a competitor over claims it intentionally and in bad faith registered and used an almost identical domain name.
411 Kitchen Cabinets LLC seller filed a complaint on Feb. 9 in the U.S. District Court for the Southern District of Florida, Palm Beach Division against King of Kitchen & Granite lnc., citing violation of the Anti-Cybersquatting Consumer Protection Act, dilution by blurring and cyberpiracy.
According to the complaint, the plaintiff operates a website with the domain name of 411kitchencabinets.com. The suit states that the defendant registered a similar name, 411kitchencabinet.com. The plaintiff purports that the defendant obtained this domain to confuse the public and deprive it of potential customers. The plaintiff alleges that it has been damaged and lost potential customers.
The plaintiff seeks the following: compensation for damages, an order to forfeit, cancel or transfer the domain name and any relief that the court may deem proper. It is represented by Adriana C. Clamens and Jeffrey Harrington of Harrington Law Associates PLLC in West Palm Beach.
