MIAMI — A Broward County man has filed a class-action suit against a Minnesota-based market research company, claiming the defendant violated federal law by using an auto-dialer to send unsolicited, non-emergency text messages.
Michael Giordano is suing Sights On Service Inc., a market research company that he says uses the fictitious name "Secret Shopper" to conduct business, citing alleged violation of the federal Telephone Consumer Protection Act. Giordano filed suit on Feb. 9 in the U.S. District Court for the Southern District of Florida Fort Lauderdale Division.
According to the complaint, the plaintiff alleges that he is still receiving unwanted text messages. The plaintiff holds Sights On Service Inc. responsible because the defendant allegedly did not stop sending non-emergency unsolicited SMS.
The plaintiff seeks the following: compensation for actual or statutory damages, attorneys’ fees and costs and any further relief that the court may deem reasonable and just.
