Guardian Life Insurance Co. accused of denying benefits

MIAMI – A man claims that his insurance company allegedly denied him disability benefits.

Marc Golin filed a complaint on Feb. 8 in the U.S. District Court for the Southern District of Florida against The Guardian Life Insurance Co. of America alleging that the life insurance company violated the Employee Retirement Income Security Act by terminating his disability benefits claim.

According to the complaint, the plaintiff alleges that he applied for disability benefits on Dec. 14, 2014. Golin alleges that the defendant refused to pay his benefits, stating that he is not disabled.

The plaintiff seeks the following: reinstatement to the benefits plan, attorney’s fees and costs, prejudgment and post-judgment interest and any further relief that the court may deem just and proper. He is represented by Victor Peña of Attorneys Dell & Schaefer Chartered in Hollywood.
