Excavating company accused of violating wage law

MIAMI — Three former employees are suing an excavating contractor and the company's president in a wage case.

Plaintiffs Julian Arce, Roberto Cardona and Amador Luviano have filed a class-action lawsuit against defendants Pinnacle Engineering & Development Inc. and William J. Way, in a claim alleging that the plaintiffs were not paid overtime wages they were owed.

The former employees sued on Feb. 8 in U.S. District Court for the Southern District of Florida, claiming the defendants knowingly violated the federal Fair Labor Standards Act with the alleged failure to pay overtime.

The plaintiffs seek the following: compensation for liquidated damages, pre-judgment interest, attorneys’ fees and costs and any further relief that the court may deem just and proper. They are represented by Cathleen Scott of Scott Wagner & Associates, P.A. in West Palm Beach, Florida.
