General Asphalt Co. sued over alleged non-payment of proper overtime wage

MIAMI – An assistant to the controller is suing an asphalt manufacturer over claims of unpaid wages.

Eric Rodrue filed a complaint on Feb. 3 in the U.S. District Court for the Southern District of Florida against General Asphalt Co. Inc., alleging violations of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was paid only the flat rate for all hours worked every week. The plaintiff holds General Asphalt Co. Inc. responsible because the defendant allegedly refused to pay the full and proper overtime rate for all hours worked in excess of the 40 hour work week.

The plaintiff seeks the following: compensation for proper overtime pay, liquidated damages, plus interests, attorneys’ fees and costs and any other remedy that the court may deem just and appropriate. He is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
