Woman sues over unwanted collection calls

MIAMI — A Florida woman is suing CarMax Business Services LLC, doing business as CarMax Auto Finance, claiming the company has violated the law by making repeated collection calls.

Adriana Arias is suing CarMax Auto Finance, a financing firm, citing alleged violation of telephone harassment statutes.

The Miami-Dade resident filed a complaint on Feb. 1 in U.S. District Court for the Southern District of Florida alleging that CarMax Auto Finance knowingly violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that, between July 2015 and January 2016, she received numerous robotic phone calls. The plaintiff alleges that she notified the company in July 2015 that she did not wish to receive calls, and she holds CarMax Auto Finance responsible because the defendant allegedly continued to call repeatedly using a prerecorded human voice.

The plaintiff seeks the following: compensation for damages amounting to $2,000 per call, attorney’s fees, costs and expenses and any other relief that is just and proper. She is represented by Jason Weaver of Jason Weaver P.A. in Hollywood, Florida.
