Woman claims security company violated FMLA

FORT MYERS — A former employee of a security company is suing the company for allegedly violating her rights under the Family and Medical Leave Act (FMLA) and causing her to resign.

Lucille Fernandez filed a lawsuit on Dec. 10 in U.S. District Court for the Middle District of Florida Fort Myers Division against G4S Secure Solutions (USA) Inc., citing alleged violation of the FMLA.

According to the complaint, Fernandez worked for the defendant as a security officer from May 2013 until her constructive discharge on Sept. 17, 2015. The plaintiff claims that she availed herself of unpaid leave pursuant to the FMLA for her pregnancy from July 6, 2015 through July 21, 2015. When the plaintiff returned to work, the suit alleges, her work schedule was changed to her disadvantage and her pay was cut. The plaintiff claims she was forced to resign as a result of the defendant's actions.

Fernandez seeks damages for back pay, an equal amount as liquidated damages, monetary damages, equitable relief, declaratory relief, attorneys’ fees, and costs. She is represented by Richard Celler of Richard Celler Legal PA in Davie, Florida.
