Wells Fargo requests move of debt collection case from state to federal court

MIAMI – Wells Fargo Bank is petitioning to remove a mortgage foreclosure case from the Eleventh Judicial Circuit in Dade County to the U.S. District Court for the Southern District of Florida.

Wells Fargo Bank N.A. filed a lawsuit Jan. 4 in U.S. District Court for the Southern District of Florida against Christiano Lisboa, David Duran, Roberto Judex, Mortgage Electronic Registration System Inc. as nominee for Citimortgage Inc., Century Park Condominium Association Inc., the City of Miami and others, alleging violations of the Fair Debt Collection Practices Act.

In the original case, Wells Fargo sued Lisboa on Jan. 2, 2013, to foreclose on a mortgage. Although that case was filed in a lower court, the suit claims it should be removed to federal court because the claims arise under U.S. law, not local or state laws.
