Woman sues Santa Fe News & Espresso, alleging FLSA violation

MIAMI — A former employee of Santa Fe News & Espresso is suing the parent corporation for allegations of unpaid overtime compensation.

Ivette Estrada filed a lawsuit Dec. 23 in the U.S. District Court for the Miami Division of the Southern District of Florida against Sunny Isles Beach Restaurant Corp., doing business as Santa Fe News & Espresso, citing violation of the Fair Labor Standards Act (FLSA).

According to her complaint, Estrada was employed by the defendant from Aug. 15, 2009, through August 2012, working as an hourly-paid kitchen staffer. During the time of employment, her hourly rate increased from $10 per hour to $12 per hour, the claim states. The defendant allegedly failed to compensate for time worked in excess of 40 hours per week at a rate of one-and-one-half times the regular pay rate in violation of the FLSA. The plaintiff claims to have regularly worked over 40 hours per week with strict supervision on a rigid schedule.

Estrada seeks damages for all overtime work, liquidated damages in an equal amount, attorney’s fees, costs, pre-judgment interest and a trial by jury. She is represented by Richard Celler of Richard Celler Legal, PA, in Davie.
