Warehouse worker sues Dukes Transportation for alleged unpaid wages

MIAMI — Dukes Transportation is being sued by an employee for allegations of unpaid overtime wages.

Jiovanny F. Membreno Alaniz filed a lawsuit, on behalf of himself and all others similarly situated, on Dec. 28, 2015, in the U.S. District Court for the Southern District of Florida against Fresh Transportation & Logistics Inc. (also known as Dukes Transport), Judith Padilla and Osmany Padilla, citing violations of the Fair Labor Standards Act (FLSA).

According to the complaint, the plaintiff was employed by the defendants as a warehouse worker from June 15, 2008, through the present. The plaintiff alleges that during his employment period, he worked an average of 57 hours per week without ever receiving overtime wages at a rate of time and one half of his hourly wage of $10 per hour. The defendants reportedly failed to compensate for overtime in violation of the FLSA federal overtime laws.

Alaniz seeks double damages and attorney fees to be proven at the time of trial, along with court costs and interest. He is represented by J.H. Zidell PA, in Miami Beach.
