MIAMI — A passenger aboard the cruise ship Carnival Magic is suing Carnival for claims that their negligence caused her to fall and injure herself.
Linda Blanchard filed suit Dec. 28, 2015, in the U.S. District Court for the Miami Division of the Southern District of Florida against Carnival Corporation, citing negligence.
According to the complaint, Blanchard was a paying passenger aboard the defendant’s vessel, the Carnival Magic, on Feb. 27, 2015, when she tripped and fell over a raised metal threshold on the floor located near the elevator on Deck 10. The plaintiff claims that the accident incurred injuries to her body, physical pain and subsequent medical treatment. Blanchard avers that her injuries were a direct result of the defendant’s negligence and failure to provide a safe environment for its passengers.
Blanchard seeks all damages recoverable by law, exclusive of costs and interest. She is represented by Michael A. Winkleman and Peter J. Ridge of Lipcon, Margulies, Alsina & Winkleman PA, in Miami.
