Man claims Pasha LLC failed to provide overtime and workers' compensation

MIAMI — A former forklift operator is suing Pasha LLC for their alleged failure to pay overtime wages and violation of workers’ compensation laws.

Markis Pierre filed suit Dec. 31, 2015, in the U.S. District Court for the Southern District of Florida against Pasha LLC, doing business as Ganee Stone, citing violations of the Fair Labor Standards Act (FLSA) and workers’ compensation laws.

According to the complaint, Pierre was an employee of the defendant from January 2013 until July 31, 2015, working as a non-exempt forklift operator. During his employment period, the plaintiff claims he regularly worked 45-50 hours per week and was paid a flat rate between $300-500 weekly, regardless of the overtime worked. Pierre avers that the defendant was aware of the overtime hours and did not comply with the FLSA to compensate accordingly.

On July 30, 2015, the plaintiff claims he injured his back while operating the forklift, reported the incident to his supervisor, and was told to keep working. The following day, the plaintiff asked to be sent to a doctor for the injury and was allegedly told to wait it out. Pierre claims he was terminated by the end of that day, violating workers’ compensation laws.

Pierre seeks lost wages and/or benefits as a result of his termination, compensatory, liquidated and punitive damages, interest, attorney’s fees and a trial by jury. He is represented by Charles M. Eiss and Lindsay M. Massillon of the Law Offices of Charles Eiss, PL, in Plantation.
