MIAMI — A Florida woman is removing a claim against CitiMortgage Inc., originally filed in Miami-Dade County Circuit Court, to federal court, alleging violation of federal real estate law.
Oneida Lopez filed a suit on Dec. 30 in the U.S. District Court for the for the Southern District of Florida Miami-Dade Division against CitiMortgage Inc., alleging violation of the Real Estate Settlement Procedures Act (RESPA), violation of Regulation X, and purported negligence.
The claim signifies a removal of an action pending in the Circuit Court in and for the Eleventh Judicial Court in Miami-Dade County, Florida, allegedly pursuant to a question of federal jurisdiction. Lopez claims the defendant violated RESPA and Regulation X, and in doing so, acted with willful negligence.
