Former BG Group employee collectively sues over FLSA violation claim

PALM BEACH – A former demolition worker is filing a putative class-action suit against The BG Group over allegations of unpaid overtime.

Andre Ayden filed a federal class-action suit on Dec. 30 on behalf of himself and all others similarly situated, in the U.S. District Court for the Southern District of Florida against The BG Group LLC, Steven Greenberg and Ivy Greenberg, citing violations of the Fair Labor Standard Act (FLSA).

According to the complaint, Ayden worked for the defendants from 2009 until December 2014 as a demolition laborer and machine operator. The BG Group serves to demolish buildings and other structures as well as on-site clearing and remediation for clients across Florida, the suit states. The plaintiff alleges that he consistently worked more than 40 hours per week throughout his employment and was never compensated with overtime wages.

Defendants Steven and Ivy Greenberg are the managing members of The BG Group responsible for the allegedly unlawful pay practices. The plaintiff claims the defendants underpaid him and other employees willfully and in violation of the FLSA that requires employers to pay a required overtime rate of one-and-one-half times the regular rate pay.

Ayden seeks a collective action designation, an issuance to be sent to all similarly situated individuals who worked for the defendant within the past three years, damages for unpaid overtime, an incentive or service award, attorneys’ fees and costs. He is represented by Mitchell L. Feldman of the Feldman Law Group PA in Tampa.
