Alps South accuses Ohio Willow Wood of patent infringement

0ac14672

TAMPA, Fla. – A St. Petersburg company that patented a liner made for prosthetic limbs is suing a competitor claiming they have continued producing and selling the product after previously losing a patent dispute.

Alps South LLC and Applied Elastometrics Inc. (an involuntary plaintiff) filed a lawsuit Jan. 5 in U.S. District Court for the Middle District of Florida against The Ohio Willow Wood Co., alleging patent infringement.

According to the complaint, Applied Elastometrics sold a patent for tear-proof, gel prosthetic liners to Alps South in 2008. However, Ohio Willow Wood continues to sell a product that infringes on several Alps and AEI products, despite previously losing a $4 million court case that found it infringed on the Alps patent.

Alps seeks a jury trial and recovery of damages, lost profits, royalties and interest in an amount to be proven at trial, plus attorneys’ fees. It is represented by attorneys Stefan V. Stein, Cole Y. Carlson and Gray Robinson of Tampa.
