A Palm Beach County resident has filed a lawsuit against a local supermarket, alleging negligence after suffering serious injuries from a slip and fall incident. On April 10, 2025, Mayra Bustamante filed the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Presidente Supermarket No. 39, Inc.
The lawsuit stems from an incident that occurred on May 19, 2023, when Bustamante was shopping at Presidente Supermarket No. 39 located at 4753 N. Congress Ave., Boynton Beach. According to the complaint, Bustamante slipped on a liquid substance presumed to be water while she was lawfully on the premises as a business invitee. The fall resulted in serious traumatic bodily injuries for which she is seeking damages exceeding $50,000.
Bustamante's complaint accuses Presidente Supermarket of negligence for failing to maintain safe conditions within their store. She claims that the supermarket had a non-delegable duty to ensure reasonable care in inspecting and maintaining their premises to safeguard customers like herself. The lawsuit lists several specific allegations of negligence against the supermarket: failing to adhere to proper cleaning schedules, allowing dangerous conditions to persist or be created within the store, neglecting to warn customers about these hazards, and inadequately repairing or inspecting areas where such incidents could occur.
As detailed in her filing, Bustamante asserts that due to Presidente Supermarket's negligence, she suffered extensive physical and emotional harm including pain and suffering, disability, disfigurement, mental anguish, and loss of enjoyment of life. She also mentions incurring expenses related to hospitalization and medical care as well as experiencing an inability to perform household services following her injury.
