Arselaine Augustin, a private duty nurse, has filed a lawsuit against Lifespace Communities, Inc., The Sherwin Williams Company, and an individual referred to as John Doe, following an incident that resulted in significant injuries. The complaint was filed on April 9, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida. According to the complaint, on June 30, 2023, Arselaine Augustin was working as an independent contractor at Harbour’s Edge Senior Living Facility in Delray Beach, Florida. This facility is owned and operated by Lifespace Communities, Inc. On the same day, John Doe was performing work at the facility as an employee of The Sherwin Williams Company. While exiting a resident's room, Augustin tripped over John Doe and sustained serious bodily injuries. The plaintiff claims that this incident resulted from negligent behavior on the part of John Doe and vicariously implicates The Sherwin Williams Company for his actions during his employment.

The lawsuit outlines several allegations against each defendant. For John Doe and The Sherwin Williams Company, Augustin asserts that their negligence directly caused her physical harm and suffering. She details various consequences such as disability, loss of enjoyment of life, medical expenses, and aggravation of pre-existing conditions due to this negligence. Moreover, she holds Lifespace Communities accountable for failing to maintain a safe environment for business invitees like herself. She argues that they did not provide adequate warnings about potential hazards or ensure safe premises conditions.

Augustin seeks compensatory damages exceeding $50,000 for her injuries and losses from all defendants involved. Her demands include compensation for bodily injury, mental anguish, medical care costs, lost wages and earning capacity among other damages deemed justifiable by the court.
