On February 11, 2025, Raymond Fanali filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Fun Depot, Inc., accusing the company of failing to maintain safe conditions at its amusement facility.
The lawsuit stems from an incident that occurred on January 13, 2024, when Fanali visited Fun Depot's go-kart track located at 2003 10th Ave., Lake Worth, FL. According to the complaint, while Fanali was lawfully on the premises as a business invitee and operating a go-kart in the pit lane at the end of his session, another go-kart operator collided with him at high speed. The plaintiff claims that this accident resulted from Fun Depot's negligence in maintaining its facilities and ensuring safety for patrons.
Fanali's attorney argues that Fun Depot had a "non-delegable duty" to ensure the safety of its premises and attractions for all visitors. The complaint lists several alleged failures by Fun Depot, including inadequate maintenance of go-karts' governor systems, insufficient monitoring of track activities to prevent collisions, and lack of proper employee training. These oversights are claimed to have created dangerous conditions that led directly to Fanali's injuries.
